1. Scope
These terms apply to every contract between Amberro — Damian Hooft ("we") and consumers ("you") for the purchase of a personalised children's book as an eBook through this website.
2. How the contract is formed
What is shown on this website is not a binding offer. You make an offer by clicking the payment button in the last step. The contract is formed when we confirm your payment. We send you a confirmation by email.
We store the contract text and send it to you with that confirmation.
3. What you get
A 26-page picture book as a PDF file, in which the child you name plays the leading part, with your dedication at the front. The pictures are made specifically for your order.
The book is a gift, not a portrait. The drawn character resembles the child but is not identical to it. We cannot promise a particular degree of likeness.
4. Prices and payment
The price shown on the order page applies. All prices are final prices and include statutory VAT. There are no shipping costs, because nothing is shipped.
5. Delivery
We send the finished book to the email address you give us. It usually takes a few minutes; we guarantee delivery within 24 hours of payment.
If production fails, we tell you and refund the price.
6. Right of withdrawal
You have a right of withdrawal, but it can lapse early. The details are in the withdrawal policy, which forms part of these terms.
7. What you may do with the book
You may read, save, print and have printed the book for private purposes without limit — as often as you like, at home or at a copy shop. You may pass it on within your family.
You may not sell it, make it publicly available, or use it commercially.
8. The photo you upload
You warrant that you are entitled to use the photo and that you either hold parental responsibility yourself or have obtained the consent of the person who does. We use the photo solely for your order.
9. Defects
The statutory rights for defects in digital products apply (§§ 327 ff. BGB). If something is wrong with your book, simply reply to the delivery email.
10. Liability
We are liable without limitation for intent and gross negligence and for injury to life, body or health. For ordinary negligence we are liable only for breach of a material contractual duty, limited to the foreseeable damage typical of the contract.
11. Governing law
German law applies. Mandatory consumer protection provisions of the country in which you are habitually resident are unaffected.
