Terms and conditions

1. Scope

These terms apply to every contract between Amberro ("we") and consumers ("you") for the purchase of a personalised children's book as an eBook through this website and, if you order it afterwards, of the same book as a printed hardcover.

2. How the contract is formed

What is shown on this website is not a binding offer. You make an offer by clicking the payment button in the last step. The contract is formed when we confirm your payment. We send you a confirmation by email.

We store the contract text and send it to you with that confirmation.

3. What you get

A 26-page picture book as a PDF file, in which the child you name plays the leading part, with your dedication at the front. The pictures are made specifically for your order.

After the eBook is delivered you can order the same book as a hardcover: a firm cover, 21 × 28 cm, 32 pages, the same pictures and the same story. It is printed for you alone. You can also order the hardcover together with the eBook straight away (hardcover with eBook): you pay once, we deliver the eBook first by e-mail, and the printed book follows by post.

The book is a gift, not a portrait. The drawn character resembles the child but is not identical to it. We cannot promise a particular degree of likeness.

4. Prices and payment

The price shown on the order page applies. All prices are final prices and include statutory VAT. For the eBook there are no shipping costs, because nothing is shipped. For the hardcover the price shown on your book page applies, plus the shipping costs shown there; from two books shipping is free. The eBook payment is already included in the hardcover's price; nothing is offset and nothing is refunded. For the hardcover with eBook the total price for both shown on the hardcover page and on the order page applies, plus the shipping costs shown there.

5. Delivery

We send the finished book to the email address you give us. It usually takes a few minutes; we deliver at the latest 24 hours after payment.

If production fails, we tell you and refund the price.

5a. The hardcover

We ship the hardcover to addresses in Germany only. It is printed in Europe after payment and is usually with you within 5 to 10 working days; as soon as it is on its way you get an email, usually with the tracking link. For the hardcover with eBook, printing starts once we have delivered the eBook to you.

6. Right of withdrawal

For the eBook you have a right of withdrawal, but it can lapse early. For the hardcover there is no right of withdrawal, because it is made to your specifications (§ 312g para. 2 no. 1 BGB). The details are in the withdrawal policy, which forms part of these terms.

7. What you may do with the book

You may read, save, print and have printed the book for private purposes without limit, as often as you like, at home or at a copy shop. You may pass it on within your family.

You may not sell it, make it publicly available, or use it commercially.

8. The photo you upload

You warrant that you are entitled to use the photo and that you either hold parental responsibility yourself or have obtained the consent of the person who does. We use the photo solely for the books you order from us.

9. Defects

For the eBook the statutory rights for defects in digital products apply (§§ 327 ff. BGB); for the hardcover the statutory rights for defects in goods (§§ 434 ff. BGB). If something is wrong with your book, simply reply to the delivery email.

10. Liability

We are liable without limitation for intent and gross negligence and for injury to life, body or health. For ordinary negligence we are liable only for breach of a material contractual duty, limited to the foreseeable damage typical of the contract.

11. Governing law

German law applies. Mandatory consumer protection provisions of the country in which you are habitually resident are unaffected.
